General Conditions of Sale

These General Conditions of Sale ("CGV") govern all purchases of premium subscription services on the Mouqabalah platform ("Platform"), operated by Kube IT Consulting FZCO, Dubai Silicon Oasis, DDP Building A2, Dubai, United Arab Emirates ("Mouqabalah", "we", "us", or "our"). By purchasing a subscription, you ("Customer" or "User") agree to these CGV in their entirety, in addition to our Terms of Use and Privacy Policy. These CGV prevail over any contradictory document in the event of a conflict.

Article 1 — Scope and Service Description

These CGV apply to the purchase of premium subscription access to the Mouqabalah marriage introduction platform. The service consists of a digital intermediary service enabling Muslim individuals to create profiles and participate in a Sunnah-compliant, wali-mediated marriage introduction system.

The Platform is accessible globally. The Customer is solely responsible for verifying that use of the Platform is lawful under the laws of their country of residence and for paying any applicable local taxes or duties.

By placing an order, the Customer acknowledges having read these CGV in full and accepts them unreservedly. Data recorded in our systems constitutes proof of all transactions concluded with the Customer.

Article 2 — Prices and Plans

Subscription prices are displayed on the Platform at the time of order. All prices are in Euros (EUR) and are inclusive of any applicable taxes unless otherwise stated. Prices for users outside the EU may be displayed net of VAT; applicable taxes may be added at checkout depending on your jurisdiction.

Current subscription plans (same price for all users):

Premium Monthly: €9.99 per month (after a 30-day free trial)

Premium 6 Months: €49.95 for 6 months (after a 30-day free trial)

Prices are firm and non-revisable for the duration of a billing cycle. Mouqabalah reserves the right to modify prices at any time outside of an active billing period. Any price change will be communicated to the Customer at least 30 days in advance via email, and will take effect at the next renewal. If the Customer does not accept the new price, they may cancel before the renewal date.

Promotional or limited-time pricing (including founding member offers) is valid only during the stated promotional period and cannot be combined with other offers unless explicitly stated.

Article 3 — Free Trial

All users benefit from a 30-day free trial period. No credit card is required to begin the free trial. At the end of the trial period, continued use of premium features requires purchasing a subscription.

The free trial is limited to one per person and per email address. Attempts to obtain multiple free trials are a violation of our Terms of Use. We reserve the right to terminate a free trial immediately if we determine the trial is being abused or if the account violates our Terms.

During the free trial, access may be limited at our discretion. We make no guarantee that the trial will be extended or that the same features will be available after the trial ends.

Article 4 — Ordering and Payment

Orders are placed directly on the Platform. The Customer selects a subscription plan, proceeds to checkout, and provides valid payment details. The sale is considered final upon successful payment processing.

All payments are processed securely by Stripe, Inc., a PCI-DSS Level 1 certified payment processor. Payment data (card number, CVV) is transmitted directly to Stripe and is never stored on Mouqabalah servers. By providing payment information, the Customer agrees to Stripe's terms of service.

Accepted payment methods include credit and debit cards (Visa, Mastercard, and others supported by Stripe). Payment is charged immediately upon confirmation of the order. For subscription renewals, payment is charged automatically at the start of each new billing cycle.

A payment confirmation and invoice will be sent to the Customer's registered email address following each successful transaction. Invoices are also accessible from the Customer's account dashboard.

In the event of a payment failure, the Customer will be notified and access to premium features may be suspended until the payment is resolved. We reserve the right to retry failed payments in accordance with Stripe's retry logic.

Article 5 — Subscription Terms and Automatic Renewal

Subscriptions are recurring and renew automatically at the end of each billing cycle (monthly or 6-monthly depending on the plan selected) unless cancelled by the Customer prior to the renewal date.

The Customer will receive a reminder email at least 7 days before the renewal of a 6-month plan. For monthly plans, the Customer may cancel at any time via their account settings or the Stripe customer portal, effective at the end of the current billing period.

Automatic renewal constitutes a contract of indefinite or determined duration with tacit reconduction. In accordance with applicable consumer protection legislation where applicable:

• For subscriptions of determined duration with tacit reconduction, the Customer is informed of the renewal date and their right not to renew at least one month before the renewal date for 6-month plans.

• If such notice is not provided in accordance with applicable law, the Customer may terminate the contract free of charge at any time from the renewal date.

Article 6 — Service Delivery

Access to the subscribed features is activated immediately upon confirmation of payment. The service is delivered digitally through the Platform and is accessible 24 hours a day, 7 days a week, subject to maintenance, force majeure, and technical availability.

We commit to making reasonable efforts to provide continuous service availability. However, we do not guarantee uninterrupted access and reserve the right to perform maintenance, updates, or modifications to the Platform at any time without prior notice. Planned maintenance will be communicated in advance where reasonably practicable.

Mouqabalah provides a marriage introduction intermediary service only. We do not guarantee that any introduction will lead to a successful outcome or marriage. The Platform's obligation is one of means (obligation de moyens), not of results (obligation de résultat).

Article 7 — Cancellation

The Customer may cancel their subscription at any time via the account settings on the Platform or through the Stripe customer portal. Cancellation takes effect at the end of the current billing period. The Customer retains access to premium features until that date.

Cancellation of a subscription does not result in a refund of amounts already paid for the current billing period, except as set out in Article 8 (Right of Withdrawal) below.

We reserve the right to cancel or terminate a subscription immediately, without refund, in the event of serious breach of our Terms of Use, including but not limited to: fraudulent behaviour, abuse, harassment, or any conduct that endangers the safety or integrity of the Platform or its users.

Article 8 — Right of Withdrawal and Refund Policy

For customers located in the European Union, and in accordance with Article L221-18 of the French Consumer Code and equivalent provisions in other EEA member states, you have a right of withdrawal of 14 days from the date of purchase of a new subscription ("Withdrawal Period").

However, by proceeding with your purchase and clicking "Subscribe" (or equivalent confirmation button), you: (i) expressly request that we begin providing the digital service immediately upon payment confirmation; (ii) acknowledge that you have been informed that your right of withdrawal will be lost once the digital service has been fully performed; and (iii) expressly and unambiguously waive your right of withdrawal from the moment you first access any premium feature, in accordance with Article L221-28(13°) of the French Consumer Code and equivalent provisions applicable in Belgium (Art. VI.53, 13° of the Code of Economic Law) and the Netherlands (Art. 6:230p(f) sub 3 BW). This waiver is irrevocable once you have accessed a premium feature.

If you wish to exercise your right of withdrawal before accessing any premium feature, you must notify us within 14 days of purchase by emailing [email protected] with the subject line "Right of Withdrawal" and providing: your name, account email, order date, and order reference. We will refund the full purchase price within 14 days of receiving your valid withdrawal notice, using the same payment method used for the original transaction.

Outside of the statutory withdrawal right, we do not offer refunds for unused portions of a subscription period. Exceptions may be granted at our sole discretion in cases of documented technical failure on our side that prevented access to the service for a substantial portion of the billing period.

Article 9 — Liability and Guarantees

Our total liability to the Customer for any claim arising under these CGV is capped at the greater of: (a) the total amount paid by the Customer in the 24 months preceding the claim, or (b) €50. We are not liable for any indirect damages, loss of earnings, loss of data, or any other consequential loss arising from the use of or inability to use the Platform.

Mouqabalah is not responsible for the acts, omissions, representations, warranties, or negligence of any user. All interactions with other users are at the Customer's own risk.

We shall not be liable for any failure or delay in performance caused by a force majeure event, meaning any event beyond our reasonable control that could not have been foreseen, prevented, or avoided, including but not limited to: acts of God or natural disasters (floods, storms, earthquakes), epidemics or pandemics, fire or explosion, war, terrorism, civil unrest, embargoes or sanctions, acts of governmental or regulatory authorities, failure of third-party infrastructure (including internet or electricity networks), strikes or industrial action, cyberattacks, DDoS attacks, or failures of cloud hosting or payment processing providers. In the event of a force majeure event, our obligations are suspended for the duration of the event. We will notify you of the force majeure event as soon as reasonably practicable.

Article 10 — Personal Data

The collection and processing of personal data in connection with a subscription is governed by our Privacy Policy, available at mouqabalah.com/privacy. Data necessary for billing and subscription management (including Stripe customer identifiers) is processed for the performance of the contract. We do not sell or share payment-related data with third parties other than Stripe.

Article 11 — Intellectual Property

All content on the Platform — including software, trademarks, logos, texts, graphics, and the Mouqabalah brand — is the exclusive property of Kube IT Consulting FZCO or its licensors and is protected by applicable intellectual property laws. Any reproduction, redistribution, or use of Platform content without our prior written consent is strictly prohibited and may give rise to civil and criminal proceedings.

Article 12 — Governing Law, Language, and Disputes

These CGV are governed by the laws of the United Arab Emirates. If you have a dispute or complaint, please contact us first at [email protected] — we will do our best to resolve it promptly and fairly.

If amicable resolution fails, any dispute shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE, without prejudice to mandatory consumer protection provisions applicable in the Customer's country of residence.

EU consumers may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/. Mandatory consumer protection provisions applicable in your country of residence are not waived by this Section.

These CGV are drafted in English. French and Dutch translations are provided for informational purposes only. In the event of any conflict between the English version and a translation, the English version prevails.
